Start-ups and SMEs held their breath in April when HMRC confirmed that EU State Aid approval for the EMI scheme, which reduces the taxation of employee share options for SMEs, would expire on 6 April 2018. This meant that the beneficial tax status of EMI share options granted on or after 7 April 2018 was uncertain. Earlier today, the European Commission issued a press release confirming that EU State Aid approval has now been granted and so EMI options can now be granted on the same tax terms as before.
